Terms of Service

These Terms of Service ("Terms") govern your use of https://squishiii.com and any purchase made through it (the "Service"), operated by Forenzo OÜ (registry code 17583268), registered at Vilja tee 1, Savikoti küla, Viljandi vald, Viljandi maakond, 71103, Estonia, trading as Squishiii. By using the Service, you agree to these Terms. Nothing in these Terms is intended to limit any right you have under mandatory Estonian or EU consumer protection law — where anything here would otherwise conflict with such a right, your statutory right applies instead.

1. Mystery Box Products

Squishiii sells randomized "mystery box" products. When you buy one, you are purchasing the stated pack/box size; the specific character or design inside is selected at random and cannot be chosen in advance unless a product listing explicitly says otherwise. Duplicates may occur. Receiving a character you personally would not have chosen is not, by itself, a defect or a failure to match the product description, provided the product was accurately described as randomized. This does not remove or restrict your statutory right of withdrawal or your rights regarding defective or non-conforming goods — see Sections 6, 7, and 8.

2. Product Information

Product descriptions, images, prices, pack sizes, availability, and other key purchase information are provided on the relevant product page and at checkout. Product images are illustrative and minor visual differences (such as slight variation in shade or lighting) may occur; this does not excuse a material difference between the product delivered and the product as advertised.

3. Orders

You may check out as a guest or, where available, through an account. An order is submitted through the checkout process, and you'll receive an order confirmation by email once it's placed. An order confirmation does not give us the right to cancel an already-accepted contract simply because we've changed our mind. Where a genuine pricing or technical error occurs, we'll handle it transparently and in line with applicable law. We may also refuse or cancel an order where reasonably necessary — for example, for suspected fraud, illegal activity, a technical error, a duplicate order, or another legitimate reason — subject to applicable law.

4. Prices and Payment

• Applicable prices are shown on the website and at checkout.
• Applicable taxes and delivery charges are shown before you place your order, where required.
• Payment is processed securely through Stripe.
• We do not receive or store your full payment card details — these are handled directly by Stripe.
• An order may require successful payment before fulfilment.

5. Shipping and Delivery

Available shipping options, destinations, costs, and estimated delivery times are shown during checkout or on the relevant product page. Estimated delivery times are estimates, not guaranteed dates, unless we've expressly agreed a specific delivery date with you. We'll fulfil orders within the agreed timeframe; where no specific delivery period has been agreed, applicable mandatory delivery rules apply. Please provide an accurate delivery address — delays caused by incorrect delivery information, customs procedures, carrier disruption, or events outside our reasonable control may affect delivery times, subject to applicable consumer law. Delivery and the passing of risk are governed by applicable law; nothing here excludes your mandatory consumer protections.

6. Right of Withdrawal

If you're a consumer buying at a distance, you generally have the statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason, subject to the legal exceptions that apply to distance sales. To exercise this right, contact us at hello@squishiii.com. After notifying us, you'll need to return the goods within the applicable legal timeframe. Unless we've offered to cover return shipping, you may be responsible for the direct cost of returning the goods, where this has been properly disclosed to you before purchase. Refunds are handled within the legally required timeframe and include the standard delivery cost you originally paid, where required by law. Where legally permitted, we may make a deduction for any diminished value caused by handling the goods beyond what's necessary to establish their nature, characteristics, and functioning.

Beyond this statutory minimum, we currently offer a 30-day money-back guarantee on Squishiii mystery box products, as stated on the relevant product page — a longer, voluntary window on top of your legal 14-day right, not a replacement for it.

7. Returns and Refunds

It's worth being clear about two different things:

• Statutory withdrawal — the legal 14-day withdrawal right described in Section 6 (extended to 30 days by our own voluntary guarantee), which doesn't require a reason.
• Defective or non-conforming goods — if an item you receive is defective, damaged, incorrect, or otherwise doesn't conform to the contract, you retain your mandatory statutory rights regardless of the withdrawal window above. You don't need to use the withdrawal process in Section 6 for this — contact us directly and we'll sort it out.

8. Mystery Box Returns

Random selection is an inherent part of how mystery box products work, and you can't demand a specific character simply because you'd have preferred a different one. That said, the randomized nature of the product doesn't remove your statutory withdrawal right or your voluntary 30-day guarantee under Section 6. And if what you receive is defective, damaged, incorrect, or materially misdescribed, that remains subject to your consumer rights under Section 7 regardless of the mystery-box format.

9. Accounts

Creating an account is optional wherever guest checkout is available. You're responsible for keeping your login credentials reasonably secure, and should let us know if you believe your account has been compromised. We may suspend or terminate an account where reasonably necessary for security, fraud prevention, abuse, or a violation of these Terms, subject to applicable law. You can request deletion of your account at any time through your account settings.

10. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose;
• attempt to interfere with or compromise the Service;
• abuse our checkout, payment, account, or promotional systems;
• use automated methods to disrupt the Service or access it in a way it's not intended to be accessed;
• engage in fraud or fraudulent payment activity.

11. Intellectual Property

The Squishiii website, branding, text, graphics, and other original content are owned by or licensed to Forenzo OÜ unless otherwise stated, and may not be copied, reproduced, distributed, or commercially exploited without our permission, except where permitted by law.

12. Availability and Website Changes

We may modify, update, or temporarily suspend parts of the website for maintenance, security, technical, or operational reasons. We don't guarantee that the Service will always be available or error-free.

13. Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, and your statutory consumer rights remain unaffected. To the extent permitted by law, we are not liable for indirect or consequential losses that are not reasonably foreseeable or legally recoverable. Nothing in these Terms limits our liability for fraud, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot legally be limited.

14. Events Beyond Our Reasonable Control

We're not responsible for delays or failures caused by events genuinely outside our reasonable control — such as major infrastructure failures, natural disasters, war, strikes, carrier disruption, or governmental restrictions. This doesn't remove your mandatory consumer rights, and we'll take reasonable steps to minimise the impact on you.

15. Changes to These Terms

We may update these Terms from time to time. For orders already placed, changes won't retroactively remove or reduce rights that already applied to you at the time of your order. Where required, we'll communicate material changes appropriately.

16. Governing Law and Consumer Rights

These Terms are governed by Estonian law to the extent permitted by applicable law. If you're a consumer resident in another EU/EEA country, you retain any mandatory protections granted to you by the consumer law of your country of residence. If a dispute can't be resolved directly with us, you may be able to use consumer dispute resolution mechanisms available to you under Estonian or EU law.
